Terms of Service
Effective date: 9 June 2026 — Applies to luminarworks.com and the Luminar Works platform
These Terms of Service (“Terms”) govern your access to and use of the services provided by Luminar Works (Pty) Ltd (“Luminar Works”, “we”, “us”, or “our”), including the marketing website at luminarworks.com and the Luminar Works platform (collectively, “the Services”).
Please read these Terms carefully before using our Services. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

1. Acceptance of terms
By creating an account, accessing, or using the Services, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and accept these Terms on behalf of yourself or the organisation you represent.
If you are using the Services on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms. In that case, “you” refers to that organisation.
2. Description of services
Luminar Works provides a workforce and field service management platform designed to help businesses plan, schedule, and manage their operations. The specific features and capabilities available to you depend on your subscription plan.
We reserve the right to modify, enhance, or discontinue features of the Services at any time, subject to the notice obligations described in these Terms.
3. Accounts and registration
To access the Luminar Works platform, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your account credentials and not share them with others.
- Notify us immediately at privacy@luminarworks.com if you suspect unauthorised access to your account.
- Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
4. Acceptable use
You may use the Services only for lawful purposes and in accordance with these Terms. You must not:
- Use the Services for any unlawful purpose or in violation of any applicable laws or regulations.
- Upload, transmit, or distribute any content that is defamatory, obscene, fraudulent, or infringes any third-party intellectual property rights.
- Attempt to gain unauthorised access to any part of the Services, other user accounts, or our infrastructure.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the platform.
- Use automated tools (bots, scrapers, crawlers) to access or extract data from the Services without our prior written consent.
- Introduce malware, viruses, or any other harmful code into the Services.
- Resell, sublicense, or otherwise commercialise access to the Services without a separate written agreement.
- Use the Services in a manner that could damage, disable, overburden, or impair our infrastructure.
- Circumvent or disable any security or access-control features of the Services.
Violation of this section may result in immediate suspension or termination of your access without notice.
5. Subscriptions and payment
Access to the Luminar Works platform requires a paid subscription. By subscribing, you agree to the following:
- Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen plan.
- Payment is processed by Paddle, our authorised merchant of record. By providing payment details, you agree to Paddle's terms of service.
- All fees are exclusive of applicable taxes, which will be added where required by law.
- Subscriptions renew automatically unless cancelled before the renewal date.
- Refunds are provided in accordance with our Refund Policy and applicable consumer protection laws.
- We reserve the right to change pricing with at least 30 days' written notice. Continued use after the notice period constitutes acceptance of the new pricing.
6. Intellectual property
The Services, including all software, design, text, graphics, and other content, are owned by Luminar Works or its licensors and are protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services solely for your internal business purposes in accordance with these Terms. This licence does not include the right to sublicense, modify, distribute, or create derivative works.
Any feedback, suggestions, or ideas you submit regarding the Services may be used by us without restriction or compensation to you.
7. Your data
You retain ownership of all data you upload to or create within the Services (“Your Data”). You grant us a limited licence to process Your Data solely to provide the Services to you.
You are responsible for ensuring that Your Data does not infringe any third-party rights and that you have all necessary rights to provide it to us for processing.
Upon termination of your subscription, we will make Your Data available for export for a period of 30 days, after which it will be deleted in accordance with our data retention policy. For details on how we handle personal data within Your Data, see our Privacy Policy.
8. Confidentiality
Each party may have access to confidential information of the other in connection with the Services. Each party agrees to protect the other's confidential information with the same degree of care it uses to protect its own confidential information (but no less than reasonable care), and not to disclose it to third parties without the other party's prior written consent, except as required by law.
9. Service availability
We aim to provide the Services with a high level of availability but do not guarantee uninterrupted or error-free operation. Planned maintenance will be communicated in advance where possible.
We shall not be liable for any downtime, data loss, or unavailability resulting from circumstances beyond our reasonable control, including acts of God, third-party infrastructure failures, or cyberattacks.
10. Limitation of liability
To the maximum extent permitted by applicable law, Luminar Works and its affiliates, directors, employees, and agents shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, goodwill, or business opportunities.
- Damages arising from unauthorised access to or alteration of your data.
- Damages arising from your use of or inability to use the Services.
Our total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the total fees paid by you to us in the 12 months preceding the claim.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Luminar Works and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Services; (b) your violation of these Terms; or (c) your infringement of any third-party rights.
12. Termination
Either party may terminate these Terms by cancelling the subscription. You may cancel at any time from your account settings or by contacting us. Cancellation takes effect at the end of the current billing period.
We may suspend or terminate your access immediately and without notice if we determine that you have violated these Terms, engaged in fraudulent activity, or pose a risk to the security or integrity of the Services.
On termination, your right to access the Services ceases immediately. Sections 6, 8, 10, 11, and 13 survive termination.
13. Governing law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.
Any disputes arising out of or in connection with these Terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be referred to the jurisdiction of the South African courts, provided that either party may seek urgent or interim relief in any competent court.
If you are an EU/UK user, you also have the right to bring proceedings in the courts of your country of residence.
14. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or via a prominent notice within the platform at least 14 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the Services and cancel your subscription before the effective date.
